24. War Crimes of General Stanley McChrystal

A little more than a year before he was fired on June 23, 2010, for making potentially insubordinate remarks in a Rolling Stone profile, General Stanley McChrystal was appointed by President Barack Obama as commander in charge of the war in Afghanistan. He had been formerly in charge of the Joint Special Operations Command (JSOC) headed by former Vice President Dick Cheney. Most of what General McChrystal has done over a thirty-three-year career remains classified, including service between 2003 and 2008 as commander of the JSOC, a special black operations commando unit of the Navy Seals and Delta Force so clandestine that the Pentagon for years refused to acknowledge its existence.
Pulitzer Prize–winning journalist Seymour Hersh claims that the Bush administration ran an executive assassination ring that reported directly to former Vice President Dick Cheney, and that Congress had no oversight of it whatsoever. The JSOC team would go into countries, without talking to the ambassador or to the CIA station chief, find people on a to-be-killed list, execute them, and leave. There was an ongoing list of targeted people, cleared by Vice President Cheney’s office, who had committed acts of war or were suspected of planning operations of war against the United States. Hersh asserts that there have been assassinations in a dozen countries in the Middle East and Latin America. “There’s an executive order, signed by President Ford, in the ’70s, forbidding such action. It’s not only contrary—it’s illegal, it’s immoral, it’s counterproductive,” he added.
JSOC was also involved in war crimes, including the torture of prisoners in secret “ghost” detention sites. Camp Nama in Iraq was one such “ghost” facility hidden from the International Committee of the Red Cross (ICRC), the international body charged under international law with monitoring compliance with the Geneva Conventions, and given the right to inspect all facilities where people are detained in a country that is at war or under military occupation. On July 22, 2006, Human Rights Watch issued a report, titled “No Blood, No Foul,” about American torture practices at three facilities in Iraq. One of them was Camp Nama, accused of some of the worst acts of torture, and operated by JSOC, under the direction of McChrystal. McChrystal, then a Major General, was officially based at Fort Bragg in North Carolina, but he was a frequent visitor to Camp Nama and other bases in Iraq and Afghanistan under his command.

In March, 2002, American citizen Jose Padilla was arrested in Chicago and publicly accused by then-Attorney-General John Ashcroft of being "The Dirty Bomber." Shortly thereafter, he was transferred to a military brig in South Carolina, where he was held for almost two years completely incommunicado (charged with no crime and denied all access to the outside world, including even a lawyer) and was brutally tortured, both physically and psychologically. All of this -- including the torture -- was carried out pursuant to orders from President Bush, Secretary Rumsfeld and other high-ranking officials. Just as the Supreme Court was about to hear Padilla's plea to be charged or released -- and thus finally decide if the President has the power to imprison American citizens on U.S. soil with no charges of any kind -- the Government indicted him in a federal court on charges far less serious than Ashcroft had touted years earlier, causing the Supreme Court to dismiss Padilla's arguments as "moot"; Padilla was then convicted and sentenced to 17 years in prison.
Padilla -- like so many other War on Terror detainees -- has spent years in American courts trying unsuccessfully to hold accountable the high-level government officials responsible for his abuse and lawless imprisonment (which occurred for years prior to his indictment). Not only has Padilla (and all other detainees) failed to obtain redress for what was done to them, but worse, they have been entirely denied even the right to have their cases heard in court. That's because the U.S. Government has invented -- and federal courts have dutifully accepted -- a whole slew of legal doctrines which have only one purpose: to insulate the country's most powerful political officials from legal accountability even when they commit the most egregious crimes, such as imprisoning incommunicado and torturing an American citizen arrested and detained on U.S. soil.
Yesterday, in South Carolina, an Obama-appointed federal judge dismissed a lawsuit brought by Padilla against former Bush officials Donald Rumsfeld, John Ashcroft, Paul Wolfowitz and others. That suit alleges that those officials knowingly violated Padilla's Constitutional rights by ordering his due-process-free detention and torture. In dismissing Padilla's lawsuit, the court's opinion relied on the same now-depressingly-familiar weapons routinely used by our political class to immunize itself from judicial scrutiny: national security would be undermined by allowing Padilla to sue; "government officials could be distracted from their vital duties to attend depositions or respond to other discovery requests"; "a trial on the merits would be an international spectacle with Padilla, a convicted terrorist, summoning America's present and former leaders to a federal courthouse to answer his charges"; the litigation would risk disclosure of vital state secrets; and "discovery procedures could be used by our enemies to obtain valuable intelligence."
In other words, our political officials are Too Important, and engaged in far Too Weighty Matters in Keeping Us Safe, to subject them to the annoyance of the rule of law. It's much more important to allow them to Fight The Terrorists without restraints than to bother them with claims that they broke the law and violated the rights guaranteed by the U.S. Constitution. That's the mentality that has resulted in full-scale immunity for both political and now private-sector elites in a whole slew of lawbreaking scandals -- from Obama's refusal to investigate Bush-era crimes or high-level Wall Street criminality to retroactive immunity for lawbreaking telecoms and legal protection for defrauding mortgage banks. With very few exceptions -- yesterday's ruling, for instance, brushed aside a contrary decision from a Bush-43-appointed federal judge in California last year that refused to dismiss Padilla's lawsuit against John Yoo for having authorized his torture (that decision is on appeal) -- Executive Branch officials and the federal judiciary have conspired to ensure that the former are shielded from judicial scrutiny even for the most blatant and horrifying crimes.

A Reply to a Mass Email That All We Need to Do Is Remove the Current Elected Officials and Our Political System Will Be Fixed
[My response to a mass email sent by a relative trying to convince people that what need to do is to get rid of the current elected representatives and that will solve our current social/economic problems]
I would like to encourage you all to reconsider what the problem is here. You can do whatever you want to your elected officials, but they are not really the true problem. I would encourage you to look into the recent Supreme Court decision on "Citizen United vs the US" and consider the implications of unregulated corporate cash influx into our so-called democratic elections. The problem is the unchecked flow of corporate money in our democracy and the dependence of our elected officials on that money to get elected (and re-elected). Get rid of many as you want, the new ones will still be dependent on the same masters.....
Take, for instance, the Tea Party, which is corporate funded and is not about dismantling the current system. What they are about is deregulating the social system in order to continue to benefit our country's elites (this is not to discount the legitimate worries of the Tea Party masses, this is to say they are being misled by their corporate funded leadership). The first thing newly elected Tea Party Senator Rand Paul did here in KY was to seek to continue the tax cuts Bush had temporarily instituted for those that make over 250,000 dollars.
A current report from Democracy Now lets us know how bad it is for working people who have lost their jobs and/or have seen their wages frozen/cut these past few years:

Corporate Profits Were the Highest on Record Last Quarter
Record "profits" for the few through the exploitation of workers. Record "growth" for corporations through systemic economic disparity and extreme poverty for the majority of workers. Currently 1 in 7 families in America are at or below the poverty line ($22,000 for a family of four), in KY it is 1 in 4. This is disturbing to me.

Food banks across the country are serving a record number of people and many agencies are struggling to meet the demand ahead of Thanksgiving. In Texas, the Montgomery County Food Bank served a record 31,000 people last month. The Washington Post reports the demand for meals at the Arlington Food Assistance Center in Virginia
has jumped 50 percent in the past two years. In the Washington DC area, the Capital Area Food Bank is on pace to distribute a record 30 million pounds of food this year, an increase of more than 10 percent since 2009. According to the U.S. Department of Agriculture, the number of families seeking assistance from food pantries jumped from 3.9 million in 2007 to 5.6 million last year. The number of U.S.
households deemed "food insecure" also exceeded 50 million last year, amounting to a record 14.7 percent.

"Blowback" does not mean just revenge but rather retaliation for covert, illegal violence that our government has carried out abroad that it kept totally secret from the American public (even though such acts are seldom secret among the people on the receiving end). It was a term invented by the Central Intelligence Agency and first used in its "after-action report" about the 1953 overthrow of the elected government of Premier Mohammed Mossadeq in Iran. This coup brought to power the U.S.-supported Shah of Iran, who would in 1979 be overthrown by Iranian revolutionaries and Islamic fundamentalists. The Ayatollah Khomeini replaced the Shah and installed the predecessors of the current, anti-American government in Iran. This would be one kind of blowback from America's first venture into illegal, clandestine "regime change"--but as the attacks of September 11, 2001, showed us all too graphically, hardly the only one.

"It was disappointing that we’re not able to actually prosecute him," says CCR legal director Bill Quigley.
