A preliminary investigation report on the driver of last week's deadly crash in Avila Beach says tests showed 21-year-old Evan Green had a blood alcohol content of between .232 and .245.
The CHP says Green, who's from Chico, has had an expired license since 2009. According to the San Luis Obispo County Sheriff's Department website, Green was booked on suspicion of murder. The crash early Friday morning killed 21-year-old Aaron Beaver of Eureka and 21-year-old Marcus Nelson of Castro Valley. One other passenger in the car survived.
The report shows Green has a criminal record, which includes a conviction for minor in possession of alcohol in 2009. He was arrested at age 17 for driving with a blood alcohol level of .05. The case went to diversion. Green was also arrested in 2007 for public intoxication/under the influence of drugs. The case was again sent to diversion.
The report shows Green and his three friends had been drinking at bars in downtown San Luis Obispo before the crash. At the time of the crash, the report says they were headed back to a vacation home in Avila Beach owned by Green's family.
At the crash scene, officers asked Green if he was injured. It says he stated "Yeah I'm hurt but they are still in there. I was the designated driver and I'm not intoxicated so don't worry about me. Just help them."
